Customer Privacy

This privacy policy is applicable to www.digitaldays.net and www.digitaldays.com (HTML based hosting site & Flash based web design site).

Digital Days Inc. ("Digital Days") does not collect personal information about individual users except when such personal information is provided to Digital Days on a voluntary basis. For example, personal information may be gathered from a contest or sweepstakes registration, the registration process for subscription services and in connection with content submissions, postings in discussion areas or other public areas, suggestions, voting/polling activities and transactional areas. Personal information about individual users will not be sold or otherwise transferred to unaffiliated third parties without the approval of the user, except that Digital Days reserves the right to disclose such personal information: (a) to its affiliates, subsidiaries and third party agents for purposes related to credit and collection, marketing and services and products offered by Digital Days, its affiliates and subsidiaries, provided the information is required for, and is to be used only for such purposes; (b) if such disclosure is made pursuant to a requirement or request of a government agency, subpoena or other legal proceeding or otherwise required by law. The user may request to decline receiving promotional and/or marketing information from Digital Days. Notwithstanding the user's wish to cease receiving such promotional and/or marketing information, Digital Days reserves the right to contact a user regarding account status, changes to the user's Internet service agreement and other matters relevant to the underlying service and/or the personal information collected.

Digital Days reserves the right to conduct statistical analyses of user behavior and characteristics in order to measure interest in and use of the Digital Days web site and to provide advertisers with information such as the number of users that have been exposed to or clicked on their advertising banners. Digital Days will provide only aggregated data from these analyses to third parties. Also, users are advised that Digital Days may permit third parties to offer subscription and/or registration-based services through the Digital Days web site. Digital Days is not responsible for any actions or policies of such third parties and users should check the applicable privacy policy of each such third party when providing personal information. Digital Days is also not responsible for any actions of any third party sites which users access through the Digital Days web site and users are responsible for checking the applicable privacy policy of such third party sites.

Users should also be aware that when personal information is voluntarily disclosed (i.e. user name, e-mail address, etc.) in the discussion areas or other public areas of the Digital Days web site, that information, along with any information disclosed in the user's communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond the control of Digital Days.

Users also should be aware that non-personal information and data may be automatically collected through the standard operation of Digital Days's internet servers or through the use of "cookies". "Cookies" are small text files that are used by web sites to: (a) recognize repeat users; (b) track usage behavior; and (c) compile aggregate data that will permit content improvements and targeted advertising. Users should be aware that Digital Days cannot control or prevent the use of cookies or any information obtained through such cookies by advertisers or third parties. If a user does not want information collected through the use of cookies, most browsers permit the user to disable the cookie feature. However, users are advised that cookies may be required for the use of certain features on the Digital Days web site.

At the user's request, Digital Days will: (a) allow a user to decline receiving further electronic advertising from Digital Days at any time; (b) provide a user with reasonable access to his or her information that is in Digital Days's records; and (c) use reasonable efforts to allow such user to update/correct personal information which the user states is incorrect to the extent such updating/correction will not compromise Digital Days's privacy or security interests, subject to the understanding that it may be impossible to completely delete a user's information without some residual information because of backups.

Any submissions to discussion areas or other public areas on the Digital Days web site are accepted with the understanding that they are accessible to all third parties. If a user does not want his or her comments to be viewed by third parties, the user is advised not to make any submissions.

This privacy policy is effective as of February 8, 2000. Digital Days reserves the right to change this privacy policy at any time by notifying users of the existence of a new privacy policy.
